U.S. companies can sponsor H-1B visas for foreign workers through the following process:
Job Offer: The first step is for the U.S. company to extend a job offer to a foreign worker. The offer should be for a position that qualifies as a specialty occupation, meaning it requires specialized knowledge and a minimum educational requirement of at least a bachelor’s degree or its equivalent.
Labor Condition Application (LCA): Once the job offer is accepted, the U.S. employer must file an LCA with the U.S. Department of Labor (DOL). The LCA includes details about the job position, prevailing wage determination, and attestations that the employer will comply with labor laws and provide appropriate working conditions.
Form I-129 Petition: After the LCA is certified by the DOL, the U.S. employer files a Form I-129 Petition for a Nonimmigrant Worker with the U.S. Citizenship and Immigration Services (USCIS). This petition includes information about the employer, the foreign worker, and the job offer.
Supporting Documentation: The U.S. employer must provide supporting documentation along with the Form I-129 petition. This may include the employment offer letter, proof of the foreign worker’s qualifications (such as educational degrees, certifications, or experience), and any necessary additional evidence to demonstrate the specialized nature of the job.
USCIS Processing and Approval: The USCIS reviews the Form I-129 petition and supporting documents. If the petition is approved, the USCIS issues an approval notice, known as the Notice of Approval or I-797. This notice indicates that the H-1B petition has been approved, and the foreign worker can proceed with the visa application process.
Consular Processing or Change of Status: If the foreign worker is outside the United States at the time of approval, they must go through consular processing at a U.S. embassy or consulate to obtain the H-1B visa stamp in their passport. If the worker is already in the United States in a different nonimmigrant status, they may apply for a change of status to H-1B without leaving the country.
H-1B Visa Issuance: Once the foreign worker has obtained the H-1B visa or change of status approval, they can legally work for the sponsoring U.S. employer in the approved specialty occupation position.
